Accra High Court to hear ‘unlawful deportation’ suit against Interior Minister today

The Accra High court, Commercial Division will today [Friday] hear a case brought before it by an Indian National who has sued the Interior Minister, Ambrose Dery and the Director of Immigration, Mr. Kwame Takyi.

The Indian National, Kumar Sivaran sued the two at the High Court, General Jurisdiction, challenging the decision of the Minister to deport him as being unlawful. The applicant in paragraph 34 of his affidavit supporting an application for judicial review in the nature of certiorari, he [Ashok] is praying the court as follows; ·

That the Deportation Order dated 15th May, 2017 be quashed by the court · That the respondents be ordered to immediately facilitate the return of the applicant into the jurisdiction to conduct his business ·

That the respondents be ordered to restore the applicant’s work/residence permit to him forthwith cost including legal fees

Any other Order(s) as the court deem fit The applicant was arrested in his office on June 1, 2017 by officers of the Immigration Service and deported on the same day after his arrest. Mr. Ashok was deported from Ghana to India under a Deportation Order by the Minister of Interior.

The applicant in his case disputed forging any marriage certificate to support his application for citizenship as a Ghanaian. The applicant further submits that by the Minister’s conduct, he has made himself an investigator, prosecutor and an adjudicator.

The applicant further submits that since his deportation thee order director/50 percent shareholder has prepared a purported Board of Directors Resolution without his consent and is using his absence from Ghana to withdraw the company funds. It is the applicant’s prayer that the court grants his reliefs.
