The Ghana Police Service has today stopped some aggrieved youth from the Nungua Traditional Council who massed up at the premises of Orca Deco Company Ltd. purposely to stop them from constructing its office on the Spintex Road, Accra.
Residents, mainly youth, who besieged the premises told the media that the company is operating illegally after the traditional authorities secured an Interlocutory by the High Court to stop them from going ahead to construct its multipurpose shopping mall.
According to them, they will not sit aloof to see the company continue to operate in defiance to the court orders.
They lamented that the company, despite the injunction, continued with their construction work, working day and night under heavy security protection.
Both Orca Deco Co Ltd. And CEMONIT Ghana Ltd was ordered by an interlocutory injunction given by the High Court not to interfere with a disputed land situated and lying at Spintex Road in Suit No: LD / 0345 / 2021, till the final determination of the suit before the court.
Owners of the said land, Odehekpakpa King Odaifio Wellentsi & another (Plaintiffs) sued CEMONIT Ghana Limited & Another (Defendants) over the said land, seeking an interlocutory injunction under Order 25 rule 1 of CI 47.
The court presided over by Justice Kwame Gyamfi Osei granted the order for interlocutory injunction against the Defendants, CEMONIT Ghana Ltd and Orca Deco Co Ltd.
The Judge in his ruling on May 25, 2021 stated that; “This application is granted as prayed. The Defendants either by themselves, agents, servants, workmen, privies or other persons developing or dealing with the land in dispute are restrained from interfering with the disputed land till the final determination of the suit.”
The Court in granting the order explicitly restrained the defendants either by themselves, agents, servants, workmen, privies or other persons developing or dealing with the land in dispute from interfering with the disputed land till the final determination of the suit.
Meanwhile, the defendants who continue to defy the court order, have erected a gigantic structure on the land within a very short period and are still working under heavy security protection.
This seemingly disregard to the orders of the court forced the youth to storm the premises today to disrupt activities of the company but were prevented by the heavy security and military presence.
The Director of Operations of the Greater Accra Regional Command, ACP Kojo Asante told the press that they were at the scene to ensure peace.
